Oh c'mon - what harm could I do riding a bike on the deserted sidewalk at one am at approximately 5 mph?? What, could I have tragically run over a slug crossing the sidewalk? Could I have veered carelessly and run over several feet of someone's lawn? Worst thing that could happen would be that I plow thru dog shit without seeing it
You can be charged if you're WALKING drunk. What could happen then? Oh, I know, you might carelessly bump into someone on a crowded sidewalk and they'd be an insane person phobic of being touched and they'd go beserk and run into traffic and, just like that, you'd be a murderer!
Those cops knew I'd been drinking. If they thought I was going to smash into an old lady walking her dog late at night leaving her a bloody pulp of broken bones (with my bike, at walking speed - cuz I have to bike up a slight incline), they sure as fuck wouldn't have let me go.
