What constitutes possession?

This past thursday night a friend and I were pulled over by the police, in his truck. In my friends backpack was a sack and a pipe and under his seat was a second sack. On me, I had no paraphernalia or marijuana. My friend claimed all of the paraphernalia and marijuana in the car. The officer placed him and I in cuffs, and told me I was being detained.

15minutes later I was put into the back of the squad car and buckled in, still told I was being detained. I told the officer I had nothing on me, and that if I was not being placed under arrest I would like to leave. He said that since my "eyes were red" and "marijuana usage constitutes possession" - that i was being placed under arrest for possession of marijuana.

I spent the night in jail and was charged with possession.

My question is, what constitutes possession? I was under the impression that simply being a passenger in a car that a controlled substance was found in was not grounds for possession since nothing was found on me, or even under my seat. I believe I can fight the charge and get it dropped, however I think it might end up coming down to how ambiguously the officers report was worded. Thoughts?

FIGHT IT! dont plea to a lesser charge of "use" or any violation of public health code. if indeed things happen the way you say they will not be able to make the charge stick & wont dare spend the $ for a trial. r

It can vary state to state. The officer was probably correct that 'usage constitutes possession', but if they didn't test your blood or urine then there is no way for them to prove that you had any in you. Sometimes cops are just dicks.
Look up the law; do some research. I doubt you'll be convicted just going by what you've said IF you know the law going on.
Out of curiosity, what is going on with your friend and how old are you guys?

We are both 22. My friend and I both got bailed out the next day, same bond. Curious thing is, we both have the same case number - I dont know if that's odd but it seemed to be to me.

i havent heard of that before. my buddys got busted in a car. only the people that had weed on them got charged for possession. if everyone involved doesnt tell the same story of whose weed it is, then they will charge everyone at the scene. but as long as only one person claimed it and all the stories are straight, only your friend should have been charged. but the charge is not that big of a deal is it? i would say to fight it, but be sure first i guess. call a lawyer and see what he suggests. good luck. see ya.

YOU gave them permission to search your car !
Speeding (unless felony speeding) is not "probable cause" for a search, so they asked the drivers permission if they could search and he (or you) gave consent.
YOU busted YOURSELVES !!!

Arrested for possesion? Thats crazy, move to Colorado! A petty offense citation sure beats spending the night in jail!

PEOPLE: In cases like this...

Ask for a copy of the police report after 10 days of the incident and see how much detail is included in the paper. If the cop has specified that you had no possession of actual substance and he was only charging you for red eyes then you have NOTHING to worry about. If they don't have a blood test from that night they can't even prove you were high... only that you have smoked within the past X days

They had me do a blood test which proved how much active THC was in my blood when I got a DUI but I was NOT high at all (just a lil drunk)

Anyways hope your court went good I assume you already went to court since u posted so long ago...

If you didn't admit to being high or admit to anything for that matter, you can beat it.

Cops try to get as much information as they can and everything you say is recorded. The first time I was busted was at a road block with a quarter bag of dro. They all gang up on you to try to scare you or bribe you. Just tell them "I have the right to remain silent". It really does piss them off when you dont talk. Also, i dunno about you're state but in georgia, if you come to a road block or get pulled over, you dont have to roll your window down all the way, just enough to give them ur license. I love pissing the piglets off. A good lawyer will tell you things like this.

Well in most states, if you're a minor and an officer thinks you're under the influence of marijuana, they can arrest you.. but you can only get charged after you submit to a drug screen to show if you really consumed cannabis or not.. But if you're over the age of 18 then you can't be arrested for being a stoned passenger in a vehicle. Just sit there and geek out all you want, just try not to piss the cop off too bad =P
